This is the web site of The California Wine Club (“we”, “us”, or “seller”).  These terms and conditions (these “Terms”) form a binding agreement between us and you (“you” or “buyer”) governing your access to and use of the services and features available on our websites and domains, including at www.cawineclub.com and all of its webpages, subdomains, subparts of those websites (collectively, the “Site”) or any software that we provide to you that allows you to access our Site.  BY ACCESSING OR USING OUR SITE, YOU ARE ACCEPTING THESE TERMS, AND YOU REPRESENT AND WARRANT THAT YOU HAVE THE RIGHT, AUTHORITY, AND CAPACITY TO ENTER INTO THESE TERMS.  IF YOU DO NOT AGREE WITH ALL OF THE PROVISIONS OF THESE TERMS, DO NOT ACCESS AND/OR USE THE SITE.

 

Certain Legal Matters
Title to, and ownership of, all wine passes from seller to buyer at seller’s licensed premises in the State of California. Buyer takes all responsibility for either picking up the wine at seller’s licensed premises or arranging for shipment of the wine to a destination of its choice. When placing an order, buyer can authorize seller to act on buyer’s behalf in arranging for transportation of the wine at the buyer’s direction, or buyer can make independent shipping arrangements. Seller charges sales tax based on the seller’s location. Seller makes no representation as to the legal rights of anyone to ship or import any wines, alcoholic beverages or other goods into any state. The buyer is solely responsible for the shipment of wine and other goods purchased and for determining the legality and the tax/duty consequences of having the wine and other goods shipped to the buyer’s destination.

 

Shipping Charges
Prices of our wines do not include shipping charges. Buyer is responsible for any shipping costs, the cost of which varies depending on destination, number of bottles ordered and delivery options. If buyer asks seller to arrange shipping on its behalf, then the appropriate shipping charges will appear in the shopping cart during checkout. If buyer selects an expedited delivery option, the extra charge will be applied to the initial shipment only.

If buyer asks seller to arrange shipping on its behalf, then buyer is responsible for providing a current, shippable, physical delivery address. Seller cannot arrange shipments for buyer that ship to P.O. Boxes, military APOs/FPOs/DPOs/MPOs or international addresses.

In the event a shipment cannot be delivered due to an incorrect address or after three delivery attempts by the carrier, seller reserves the right to charge the applicable carrier fee for rerouting to an alternative address or reshipping to the same address.

If a shipment is returned to seller’s facility, seller will not reship until the recipient or buyer provides a deliverable address.

In the event that a shipment is returned to seller’s facility, but the recipient or buyer does not want to reship the package(s), then seller will apply a restocking fee equivalent to the original shipping charge.

If a shipment is successfully delivered to the address that has been provided but is not valid for the recipient, seller reserves the right to charge the full amount for a replacement shipment.

Seller does not assist buyers with shipments to any state where it may not be permissible.

 

You must be 21 to Purchase Alcohol
Alcoholic beverages may only be sold to persons who are at least 21 years old and the person to whom delivery is made must be at least 21 years old.  An adult signature is required at time of delivery.

By submitting your order electronically buyer is signing that buyer has read and understands the above conditions.

 

ONGOING SUBSCRIPTIONS AND CANCELLATION OF MEMBERSHIP: By submitting your order for an Ongoing Membership you authorize to process the recurring charge plus shipping to the credit or debit card you have provided until you cancel. You may cancel at any time on your account page, by calling (1-800-777-4443) 8am-5pm PST, or by emailing our customer service (info@cawineclub.com). The recipient will receive no further billings as of that date. If a shipment has already been processed prior to cancellation, it will be shipped as normal and the customer will not receive another shipment thereafter. If no shipment is in transit when you cancel, but your account contains funds owed to you, we will post the funds to your credit or debit card within 3 business days.

Recurring billing will only happen with Ongoing orders. If you select between 2-12 prepaid shipments, your membership will end after the selected number of shipments. 

 

Return Policy
If a shipment is damaged in transit we will replace the product at no additional charge. If the wine is corked from the winery, we will replace the bottle at no charge. Due to alcohol shipping laws, we are unable to accept returns.

Due to the limited time frame that delivery companies retain shipment tracking information, we do not offer reimbursements, reshipments, or replacements for delivery issues that are older than 120 days.

If your personal information changes, (such as your shipping or billing information, your preferred credit card, etc.) you can LOGIN with your personal email address and password to our secured section and add, change, or delete any information in your account.
